Definitions : The company or individual requesting the service or product of Bolton Web Design (BWD Group)

General
Bolton Web Design (BWD Group) will carry out work only where an agreement is provided either by email, telephone, mail or fax.
Bolton Web Design (BWD Group) will only carry out work only for clients who are over 18 years of age or above. An ‘order’ is deemed to be a written or verbal contract between Bolton Web Design (BWD Group) and the client, this includes telephone and email agreements.
Liability
Every endeavour will be made to ensure that the website and any scripts or programs are free of errors, Bolton Web Design (BWD Group) cannot accept responsibility or liability for any losses or damages incurred by these types of errors. The company will advise and try to resolve any issues within a agreed timeline with the client.
Bolton Web Design (BWD Group) will provide limited access to the hosting account ” cPanel ” with the restricted use of authorised employees only. Modification to existing content / coding is forbidden without approval from Bolton Web Design (BWD Group). Un authorised changes will result in possible termination of the hosting account.
The company will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
Bolton Web Design (BWD Group) will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes re content/images that have been provided to us for inclusion on the site.
Bolton Web Design (BWD Group) will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers.
Payments
Bolton Web Design (BWD Group) will require a non-refundable deposit for all development work and services carried out , the deposit sum will depend on the estimate cost of the project and is required for payment within 7 days of the invoice date. Payments that have failed to clear may be charged an administration fee. Cheques may be acceptable to a 1% charge due to standard banking fees.
Once the development has been completed the final balance is then due in accordance with our payment terms which are 7 days from the invoice date. On accepting and approving the final development there is no exception for non payment. Bolton Web Design (BWD Group) may use legal action against the client that refuse to complete payment.
If accounts are not settled or Bolton Web Design (BWD Group) have not been contacted regarding the delay, access to the related website may be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment, non payment can result in county court judgements (CCJ) being added to the clients credit rating.
Bolton Web Design (BWD Group) will agree to make any minor design changes and amendments to the development within 7 days of completion to correct any errors or adjustments that have been over looked. This does not include any structural or functional elements.
Bolton Web Design (BWD Group) will charge the standard development rate as agreed for any changes out of this period.
Copyright
The website, graphics and any programming code remain the property of Bolton Web Design (BWD Group) until all outstanding accounts are paid in full. CMS (Content Management Software) coded and designed by the company will remain the property of the Bolton Web Design (BWD Group) and cannot be re-published or modified for personal use.
Any scripts, graphics, modules, applications, php scripts, or CMS software (unless specifically agreed) written by Bolton Web Design (BWD Group) remain the copyright of Bolton Web Design (BWD Group) and may only be commercially reproduced or resold with the permission of Bolton Web Design (BWD Group).
Bolton Web Design (BWD Group) cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material. Copyrighted material will be removed by the request of the original author who can display evidence the material is copyrighted.
Compatibility
Bolton Web Design (BWD Group) will endeavour to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer Version 7 and to an acceptable level with Mozilla browsers. Bolton Web Design (BWD Group) can offer no guarantees of correct function with all browser software.
Bolton Web Design (BWD Group) will no longer offer support for Internet Explorer 6 unless specifically requested.
Hosting
Whilst Bolton Web Design (BWD Group) recommends hosting companies to host websites, no guarantees can be made as to the availability or interruption of this service by Bolton Web Design (BWD Group) cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.
In any event of a service outage Bolton Web Design (BWD Group) will aim to restore all web services within 7 days of the reported issue. This may require a server migration and DNS propagation which may take an additional 48 hours. If the service cannot be restored within 14 days Bolton Web Design (BWD Group) will issue a partial refund of the annual hosting fee for the number of days remaining on the hosting contract.
Clients requesting to migrate their website to a different hosting server can request FTP details from us to obtain the current site contents. Bolton Web Design (BWD Group) will not offer a partial refund for any service remaining on the current hosting contract , clients looking to use our hosting services again will be required to pay the standard fee.
Bolton Web Design (BWD Group) will aim to keep hosting / domain costs fixed but we do have the option to increase these if we feel that the market sector and industry costs are increasing.
Server Bandwidth and Diskspace is subjected to a fair use policy that we Bolton Web Design (BWD Group) feel that is suitable for your requirements. Bolton Web Design (BWD Group) have the right to suspend or terminate your services if this usaged is excessive.
